Pension for Length of Service and New Job: PFU Provides Important Clarification Regarding Benefit Preservation.


The Pension Fund of Ukraine responded to a question from a former teacher who receives a pension for length of service and plans to work as an assistant teacher in an inclusive class at school.
The woman contacted the PFU with a specific question: 'I worked as a teacher, now I receive a pension for length of service. Recently, I got a job at a school as an assistant to an inclusive class teacher. Will my pension payments continue?'
According to the current legislation of Ukraine, pensioners are required to notify about the fact of their employment or dismissal, as the right to receive a pension may depend on whether the person is working or not. This is stipulated in Article 16 of the Law of Ukraine 'On Mandatory State Pension Insurance'.
The pension for length of service has a special status - it is awarded when leaving the job that qualifies for this type of pension. In the case of re-employment in a position that also qualifies for a pension for length of service, pension payments are suspended and resumed only from the day of dismissal from such work. However, working as an assistant teacher in a general education institution does not qualify for a pension for length of service. Thus, the fact of working in this position does not affect the payment of the length of service pension, and the former teacher can calmly continue to receive her pension.
If a former employee of retirement age plans to work after receiving a pension, it is important to consider under what conditions this pension was awarded. In some cases, new work may affect pension payments, so it is better to consult the relevant authorities or services in advance.
